Sheet X-01

Privacy policy.

How Retreat Pools Pty Ltd collects, uses, stores and protects your personal information, written in plain English against the Australian Privacy Principles in the Privacy Act 1988 (Cth). If anything here is unclear, ask us and we will explain it.

In short

We collect the personal information we need to answer your enquiry, design, price and build your pool, and look after it afterwards. We do not sell it, we share it only with the people who help us design, approve and build, and you can ask to see or correct what we hold at any time.

Section 01 · APP 1

Who we are

Retreat Pools Pty Ltd (ABN 63 158 274 019) designs and builds custom concrete pools from our studio at Tallebudgera Creek Road, Burleigh Heads QLD 4220. In this policy, “we”, “us” and “our” refer to Retreat Pools Pty Ltd.

This policy explains how we handle personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles. It covers our website, our studio and every site we work on. We follow these principles whether or not the Act strictly applies to a business of our size.

Section 02 · APP 2, 3 and 5

What we collect

We collect only what we need for the work. Most of it comes directly from you: when you send an enquiry, call the studio, meet us on site or sign a contract. Sometimes it comes from people acting for you, such as your architect, builder or certifier, or from public records such as property and planning data.

Enquiries

Name, phone, email, suburb, pool type, budget, timeframe and anything you tell us about the project.

Clients

Site address and access details, plans and surveys, site photographs, contract and variation records, and payment records.

Job applicants

Your CV, references, licences and work history.

Website visitors

Pages viewed, device and browser type, approximate location and how you reached the site.

We do not ask for sensitive information, such as health details, and we do not store card numbers. You can browse the site and ask general questions without telling us who you are, but we need your name and contact details to visit your site or prepare a price.

Section 03 · APP 6

How we use it

We use your information to reply to your enquiry, visit and survey your site, design and price your pool, prepare contracts and approvals, build the pool, hand it over and come back for the twelve-month visit. We also use it to meet our legal obligations, including building, insurance and tax records, and to handle warranty claims for the life of the pool.

We look at website data in aggregate to understand which pages are useful. We do not sell personal information, and we will not use it for a purpose you would not reasonably expect without asking you first.

Section 04 · APP 6 and 8

Who we share it with

We share information only with the people who need it to design, approve, insure or build your pool.

Design and approvals

Structural engineers, surveyors, private certifiers, councils and water authorities.

Construction

Our subcontractors and suppliers, who need your site address and access details.

Insurance and licensing

The QBCC, for Home Warranty Insurance and pool registration, and our own insurers.

Your team

Your architect, builder or landscape designer, when you ask us to.

Advisers and systems

Our accountant and lawyers, and the IT and cloud providers that host our email, files and accounts.

Some of those cloud providers store data on servers outside Australia, including in the United States. Before we use a provider, we take reasonable steps to make sure it handles personal information in a way that is consistent with the Australian Privacy Principles.

Section 05 · APP 11

Storage and security

We keep records in secure cloud systems with individual logins and two-factor authentication, and paper plans in a locked studio. Only the people working on your project can open your file.

We keep project records for at least seven years, and longer where they relate to the structural warranty. When we no longer need information, we destroy it or remove anything that identifies you. If a data breach is likely to cause you serious harm, we will tell you and the Office of the Australian Information Commissioner under the Notifiable Data Breaches scheme.

Section 06 · Website

Cookies and analytics

Our website uses a small number of cookies. Essential cookies make forms and pages work. Analytics cookies, through Google Analytics, tell us which pages are read and how visitors find us; they do not identify you by name. Embedded maps may also set cookies controlled by Google.

You can block or delete cookies in your browser settings. The site will still work, although a form may ask you to fill it in again.

Section 07 · APP 7

Marketing

We send marketing email only when you ask for it, for example when you request the pool cost guide or subscribe to Journal notes. Every email has an unsubscribe link, and we act on it within five business days, as the Spam Act 2003 (Cth) requires.

We do not buy mailing lists, and we never pass your details to anyone else for their marketing.

Section 08 · APP 12 and 13

Access and correction

You can ask to see the personal information we hold about you at any time. Email or write to us and we will respond within 30 days. Asking costs nothing; if a request takes significant time to gather, we may charge a reasonable fee and will tell you first.

If something we hold is wrong, out of date or incomplete, tell us and we will correct it. If we refuse a request, which the Privacy Act allows in limited cases, we will explain why in writing and tell you how to complain.

Section 09 · APP 1

Complaints

If you think we have mishandled your personal information, write to our Privacy Officer using the details below. We will acknowledge your complaint within five business days and aim to resolve it within 30 days.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
